1. Introduction

Welcome to Hikepilot. These Terms and Conditions ("Terms") govern your use of our website, mobile application, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be legally bound by these Terms and all policies incorporated by reference, including our Privacy & Cookies Statement.

If you do not agree with these Terms, please do not use our Services.

Our Services enable users to research, find, and book nature experiences, hiking trips, and guiding services worldwide. These Terms apply to all Users, including guides, travelers, and casual visitors ("Users").

Our Services are not intended for minors. You must be at least the age of majority in the jurisdiction where you reside to use the Hikepilot platform.

We may change or modify these Terms from time to time. Continued use of our Services after updates constitutes acceptance of the revised Terms.

2. Parties

These Terms form an agreement between:

Hikepilot LLC ("Hikepilot," "we," "our," "us"), the platform operator and service provider; and

You, the User accessing, browsing, or using the Services, whether as a traveler, guide, or guest.

If you register as a guide or service provider, you also agree to any additional guidelines, payment terms, or partner agreements incorporated herein.

3. User Responsibilities

Users agree to:

• Provide accurate, current, and complete information when creating an account or submitting data.
• Maintain the confidentiality of their login credentials and promptly notify Hikepilot of any unauthorized access.
• Comply with all applicable laws, regulations, and these Terms when using the platform.
• Use the Services only for lawful purposes and in good faith.

Users must not:

• Copy, modify, reverse engineer, decompile, or disassemble any part of the Hikepilot platform.
• Rent, lease, sublicense, or distribute the Services to third parties.
• Use the platform in a way that may damage, disable, or impair Hikepilot's infrastructure or reputation.

4. Account and User Data

You are responsible for maintaining accurate account information and safeguarding your password. You accept all risks and liability for any unauthorized access resulting from your failure to protect your credentials.

When you submit User Data (such as profile information, booking details, or payment data), you agree that it may be processed in accordance with our Privacy & Cookies Statement.

5. Service Fees and Taxes

You are financially responsible for all activity under your account, including any fees, bookings, or transactions made through the platform.

Fees, commissions, and other charges are described on our website or service agreements. These may change at any time. By continuing to use the Services after any updates, you accept the new rates and terms.

You are responsible for any applicable taxes related to your use of the Services.

6. Ownership, Trademarks, and User Content

All platform content — including text, graphics, logos, design, and software — is the property of Hikepilot LLC and protected under copyright, trademark, and other intellectual property laws.

User Content:

By uploading or submitting content (such as listings, images, itineraries, or reviews) to the platform, you grant Hikepilot a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, adapt, publish, translate, display, and distribute such content for the operation, marketing, and improvement of the Services.

You retain ownership of your content. Hikepilot does not claim title to it.

You represent that you have the right to grant this license and that your content does not infringe any third-party rights.

7. Privacy Policy

Your use of our Services is also governed by our Privacy & Cookies Statement, which explains how we collect, use, and protect your personal data.

8. Platform Messaging and Communication

Users may send and receive messages through the Hikepilot platform to coordinate trips, ask questions, or share information.

Users agree not to:

• Send spam, unsolicited offers, or promotional messages to recipients who have not consented.
• Use messaging to harass, threaten, or mislead others.

Hikepilot may monitor, moderate, or remove messages if necessary to protect users or enforce these Terms.

Please note that message content may not be encrypted, and while we use reasonable security measures, Hikepilot cannot guarantee that communications will be free from interception or delays.

9. Payments, Refunds, and Cancellations

Traveler Cancellations

• Full Refund (100%) – if the traveler cancels within 7 days of booking, regardless of when the trip or service is scheduled.
• Partial Refund (50%) – if the traveler cancels more than 7 days after booking, but at least 7 days before the scheduled trip or service date.
• No Refund – if the traveler cancels within 7 days of the scheduled trip or service date.

Refunds will be issued to the traveler's original payment method and may take up to 10 business days to process.

Hikepilot may review refund eligibility in exceptional cases such as verified medical emergencies, natural disasters, or other force majeure events.

Guide Cancellations

If a guide cancels a confirmed booking, the traveler will receive a full refund.

Repeated or unjustified cancellations by guides may result in account suspension or termination and loss of eligibility for payouts.

Payments to Guides

Guides will receive their earnings upon successful completion of the booked service or trip, minus Hikepilot's 18% commission fee.

Payments are typically processed within 5–7 business days after completion, subject to verification, fraud prevention, or dispute resolution checks.

Payment Processing

All payments are processed securely through Hikepilot's integrated payment system.

By booking through HikePilot or listing your services as a guide, you authorize Hikepilot to collect payments, deduct applicable commissions, and disburse payouts as described above.

10. Warranties Disclaimer

The Services, Content, and Platform are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, title, or non-infringement.

Hikepilot does not guarantee uninterrupted or error-free operation, nor the accuracy, reliability, or completeness of any information provided through the Services.

11. Limitation of Liability

To the maximum extent permitted by law, Hikepilot LLC, its officers, employees, affiliates, partners, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the platform, including lost profits, data, or goodwill.

Your sole remedy for dissatisfaction with the Services is to stop using them.

12. Termination and Inactive Accounts

Hikepilot reserves the right to suspend, deactivate, or terminate any account at any time, with or without notice, for any violation of these Terms or inactivity over an extended period.

If your payment or subscription is canceled, rejected, or not received on time, your account may be deactivated without notice.

13. Force Majeure

Neither Hikepilot nor any User shall be held liable for any delay or failure to perform due to causes beyond their reasonable control, including natural disasters, government restrictions, labor disputes, power failures, internet outages, or other force majeure events.

14. Severability and Waiver

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

Failure to enforce any part of these Terms does not constitute a waiver of our rights to enforce them later.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New York, United States.

16. Updates to Terms

We may update or modify these Terms periodically. Any material changes will be communicated via our website or email. Continued use of the Services after such changes constitutes your acceptance of the updated Terms.
